Samuel R. Caldwell (Feb. 11, 1880 - Jun 24, 1941) was the second person convicted under the Marihuana Tax Act of 1937. He was arrested on October 2, 1937, the same day that the Marihuana Tax Act was enacted.
He was sentenced to 4 years hard labor at Leavenworth Penitentiary and a $1000 fine. Caldwell was 58 at the time of his conviction on October 8, 1937. He was found guilty of selling three cigarettes to a Claude Morgan. Moses Baca, the first American convicted under the 1937 Marihuana Tax Act, received 18 months incarceration for possession of a 1/4 ounce.
Caldwell died one year after his release from prison.
